This is a translation. If it differs from the Korean original, the Korean version prevails.
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the naONu app, website (naonu.app) and related services (the "Service") provided by 세온안 (the "Company"), as well as the rights, obligations and responsibilities of the Company and Users.
Article 2 (Definitions)
- User: A person who has agreed to these Terms and signed up for the Service.
- Photos: Face photos and full-body photos uploaded by a User to generate videos.
- Outputs: Videos, stills and posters created by the Service with AI and provided to the User.
- Presets: Movie scenarios, original challenge videos and original meme videos prepared by the Company.
- Recipe: A scene description written by a User. Creator Challenge: A challenge video filmed and uploaded by a User.
- Credits: Usage vouchers spent to create videos within the Service. There are Paid Credits, purchased with money, and Free Credits, received at no charge through the first purchase bonus, web purchase bonus, friend invitations, watching ads, app install missions, Recipe/Challenge rewards and the like.
Article 3 (Posting and Amendment of the Terms)
- The Company posts these Terms in the app (Me > Terms of Service) and on the website.
- The Company may amend these Terms to the extent that it does not violate applicable laws. When doing so, the Company will announce the effective date and the reason for the amendment through in-app notices, email and other means from 7 days before the effective date (or from 30 days before, for changes that are unfavorable to Users or material).
- Users who do not agree to the amended Terms may delete their account. If a User does not express refusal by the effective date, the User is deemed to have agreed, and the Company will state this in its notice.
Article 4 (Sign-up and Accounts)
- Users sign up with a Kakao, Google or Apple account. Persons under 14 years of age may not sign up.
- Users may not lend or transfer their account to others, and Users are responsible for managing their account.
- If a person signs up using another person's information, or signs up again to evade usage restrictions, the Company may refuse or terminate the registration.
Article 5 (Service Description)
- AI creates short videos (Movies, Challenges, Memes) based on Photos and Presets or Recipes.
- The Company provides additional features such as shooting with friends, gifting, sharing and rewards for Recipes and Creator Challenges, and rewards for watching ads and app install missions.
- The Company uses external AI engines (e.g., fal.ai, Higgsfield) to generate videos, and engines may change without notice for quality, cost or safety reasons.
- AI-generated results may differ each time, and the Company does not guarantee any particular result (degree of resemblance, accuracy of movements, inclusion of specific scenes, etc.). If generation ultimately fails, Credits are returned in accordance with Article 11.
Article 6 (Use of Photos and Consent)
- Users must upload only their own photos or photos of adults who have consented to being photographed and to such use. Users must not upload other people's photos without consent, or use them to imitate celebrities or real persons.
- For gifting and shooting with friends, the person in the photo uploads the photo themselves and gives consent.
- The Company uses Photos only to generate videos and does not use them for facial recognition (identity verification) or AI training. The processing and storage of Photos is governed by the Privacy Policy.
Article 7 (AI-Generated Output Labeling)
- All Outputs carry a label indicating they were made with AI (watermark, metadata, etc.) (pursuant to the Framework Act on the Development of Artificial Intelligence and Establishment of Trust, among others).
- Users must not remove or obscure the label and spread Outputs as if they were real footage.
Article 8 (Purchase of Credits)
- Paid Credits are purchased through in-app purchase on the App Store or Google Play, or through website payment (Toss Payments, KakaoPay, etc.). The price, number of Credits and bonus for each product are as displayed on the payment screen.
- The Company may change prices, products and discounts; such changes do not affect Credits purchased before the change.
- Payments by minors: If a User under 19 years of age makes a payment without the consent of a legal guardian, the User or the legal guardian may cancel it. However, this does not apply to payments within the scope permitted by the legal guardian (such as an allowance), or where the User misrepresented themselves as an adult.
Article 9 (Use and Validity of Credits)
- When creating a video, the Credits displayed on the screen are deducted. If a User has both Free Credits and Paid Credits, Free Credits are used first.
- Validity period: Paid Credits are valid for 5 years from the date of purchase, and Free Credits for 1 year from the date received (or for any shorter period announced at the time they are granted). Expired Credits are forfeited.
- Credits cannot be exchanged for cash or transferred to other Users (gifting is possible only in the manner set by the Company).
- Credits obtained by fraudulent means (automation tools, multiple accounts, manipulation of ads or missions, abuse of payment cancellation, etc.) will be reclaimed, and if they have already been used, the Company may charge their value or restrict use of the Service.
Article 10 (Ad and App Install Mission Rewards)
- Watching a rewarded ad to the end fills the credit bar, and when the bar is full, 1 Credit is granted. The number of ads that can be watched per day and the amount earned per ad are as displayed in the app, and may be changed by the Company.
- App install missions (offerwall) are provided by ad networks, and whether a mission is completed is determined by the ad network's confirmation. Use of mission apps is governed by those apps' terms, and issues relating to mission apps are the responsibility of the relevant advertiser or ad network.
- Ad and mission rewards are Free Credits.
- Spot the Flaw: when a User reports an error in a video with a screenshot, the Company reviews it and credits the reward it has set as Free Credits. Duplicate or false reports are rejected, and submitted screenshots may be used to improve the Service.
Article 11 (Generation Failure and Automatic Refund)
If a video ultimately cannot be created due to an engine error, rejection by content screening or the like, the Credits used are automatically returned (for gifts, to the sender). Credits are not returned merely because the User is dissatisfied with the result; however, for obvious errors such as a broken picture or the person not being changed at all, please contact us and, after checking, we will regenerate the video or return the Credits.
Article 12 (Withdrawal of Subscription and Refunds)
- For unused Paid Credits, Users may request withdrawal of subscription (a refund) within 7 days of the date of purchase (Article 17 of the Act on the Consumer Protection in Electronic Commerce).
- If part of the purchased Credits has been used, Users may request a refund of the unused Paid Credits even after 7 days have passed. In this case, the Company refunds the payment amount minus the value of the Credits used and costs permitted by law, such as payment fees (up to 10% of the remaining amount). The value of the Credits used is calculated at the per-Credit price of that product.
- Free Credits are not eligible for refunds. Free Credits received in connection with a payment, such as the first purchase bonus, are reclaimed together when that payment is refunded.
- For payments made through the App Store or Google Play, the refund procedures of the relevant store apply, and the Company reclaims the Credits once the store confirms the refund. For web payments, if a request is made through the app or to the email below, the Company refunds to the original payment method within 3 business days.
Article 13 (Sharing and Rewards for Recipes and Creator Challenges)
- Recipes can initially be used only by their author, and are published after the Company's review if publication is requested. When other Users use a published Recipe, 50% of the usage fee is settled monthly to the author in Credits.
- The cover of a published Recipe uses an AI-generated poster, and scenes from the author's video are used only if the author consents.
- The person in a Creator Challenge video must be the User or one adult who has given consent, and the video is published under the song title chosen by the User after the Company's review. Each time another User completes a video with those moves, the uploading User receives 1 Credits (excluding the User's own use).
- Users who upload Recipes or Creator Challenges grant the Company a royalty-free license to use the content to the extent necessary to display it in the app and to allow other Users to create AI videos based on it. If a User takes the content down, it will no longer be used for new creations, but Outputs already created by other Users may remain.
- The uploading User is responsible for any third-party rights, such as in music and choreography, included in the video.
Article 14 (Prohibited Conduct)
- Using another person's photos without consent, or creating videos that deceive others or damage their reputation
- Creating sexual videos, inappropriate videos featuring children or adolescents, or videos that incite violence, hatred or discrimination
- Impersonating celebrities, real persons or trademarks, or distorting facts by making content appear to be election material or news
- Removing the AI-generated label and spreading content as if it were real footage
- Using the Service with automation tools, or circumventing or manipulating security, payment or ad reward mechanisms
- Any other conduct that violates laws or these Terms
Article 15 (Content Management and Usage Restrictions)
- The Company may, without prior notice, take down or block publication of any Recipe, Creator Challenge or Output it deems to constitute prohibited conduct or to infringe the rights of others.
- Persons whose rights have been infringed may report it to the email below, and the Company may temporarily take down the content while it investigates.
- Depending on the severity of a violation, the Company may issue a warning, restrict features, suspend the account temporarily or terminate the account, and the User may file an objection by email.
Article 16 (Ownership of Rights)
- Users may store and share the Outputs they create for personal purposes. For commercial use (advertising, sale, etc.), Users must contact the Company in advance.
- Rights to works provided by the Company, such as Presets, app design and logos, belong to the Company or the rightful owners.
- Rights to music used in Challenges belong to the original rights holders, and when posting to external platforms, those platforms' music policies may apply.
- The Company does not use Users' Outputs to promote the Service, except to the extent a User has separately consented.
Article 17 (Changes to and Suspension of the Service)
- The Company may change or discontinue parts of the Service depending on engine or operational circumstances, and will give 30 days' notice of material changes.
- If the entire Service is terminated, the Company will give 30 days' notice and refund remaining Paid Credits in accordance with Article 12.
- The Company is not liable if the Service stops due to causes beyond its control, such as natural disasters or failures of external engines or communications, and generations that failed during that time are refunded in accordance with Article 11.
Article 18 (Damages and Limitation of Liability)
- If the Company causes damage to a User intentionally or negligently, it will compensate in accordance with applicable laws.
- Unless there is intent or gross negligence on the part of the Company, the Company is not liable for problems arising from Photos, Recipes or Creator Challenges uploaded by Users, or from Users sharing Outputs externally.
Article 19 (Account Deletion)
Users may delete their account at any time via Me > Delete account. Remaining Credits are forfeited upon deletion, so if you have Paid Credits eligible for a refund, please request the refund before deleting your account. Photos and account information are deleted in accordance with the Privacy Policy.
Article 20 (Dispute Resolution)
These Terms are governed by the laws of the Republic of Korea. If a dispute arises, the parties will first consult through the contact below; if no agreement is reached, the dispute may be submitted for mediation to the Korea Consumer Agency or the Content Dispute Resolution Committee, or resolved in the competent court under the Civil Procedure Act.
Addendum
These Terms take effect on [시행일].
